1.1) The Terms & Conditions below are a legally binding agreement between you as the Client and Pavia Party & Baby Equipment Rental Babysitting Services as the Service.

1.2.) ‘Client’ refers to the person/family using Pavia Party & Baby Equipment Rental Babysitting Services.

1.3) ‘Candidates’ refers to any person that Pavia Party & Baby Equipment Rental Babysitting Services introduces to the Client. 

1.4) The Terms & Conditions are the terms of which Pavia Party & Baby Equipment Rental Babysitting Services offers the Client access to the services. By registering with Pavia Party & Baby Equipment Rental Babysitting Services the Client agrees to abide by these Terms & Conditions.

1.5) Posting false, incomplete, inaccurate, or illegal information is strictly prohibited and may be punishable by law. 

2. Client Obligations

2.1) Any correspondence, verbal, written, or email communication is confidential and the Client agrees not to disclose it to third parties.

2.2) All babysitting bookings must be made directly between you (the Client) and Pavia Party & Baby Equipment Rental Babysitting Services (the Service). 

2.3) The Client agrees to abide by each and all terms of the Service, either in person or via electronic correspondence.

2.4) The Client acknowledges that the candidate/babysitter may not be hired outside of the direct service from Pavia Party & Baby Equipment Rental Babysitting Services, the Client relationship will be terminated if the candidate/babysitter is hired privately, and if caught client consents to allow us to sue for damages and loss of revenue for an amount no larger than USD 5000.=. Also, the babysitter will be responsible for accepting to work for you for damages and loss of revenue due to not adhering to our NONE-Compete agreement. The amount also in conjunction with this breach of contract will be for an amount no larger than USD. 5000.=

2.5) The Client agrees there is a 3-hour minimum for bookings, thereafter, Clients are charged in 1-hour increments, payable to Pavia Party & Baby Equipment Rental Babysitting Services.

2.6) The Client agrees to hold their Credit/Debit Card on file for automatic weekly billing.

2.7) The client agrees to provide parking space and pay parking fees if applicable. 

2.8) The client acknowledges and agrees that the hourly rate is $20 per hour, with a minimum of 3 hours.

2.9) The client understands that the hourly rate for On-Demand after midnight is $30 per hour for all requests made the same day or in advance of the booking start time.

2.10) The client agrees that transportation increases the hourly rate by an additional USD 10,=  for the entire duration of the booking time. This Fee will be paid out in cash to the sitter upon arrival for the reserved babysitting services.

3. Service Responsibilities

3.1) Pavia Party & Baby Equipment Rental Babysitting Services is a referral service and will make reasonable efforts to search, find, and refer potential candidates to hire and assign a babysitter. Keep in mind that the sitters you choose on the website may not be available however, we will do our best to find a suitable replacement.

3.2) Service refers to independent contractors, who are not an employee of the Client.

3.3)Client acknowledges and agrees that the sole obligation of the Service is to use reasonable efforts in locating Sitters that meet the job requirements and qualifications as specified by Client to the Service. 

3.4)The Service will screen Sitter Candidates for criminal history, driving records, Social Security Identity, current CPR and First-Aid Certification, and other items relevant for the Client to hire but this information will remain private only for the company disclosure.

3.5) The Service providers will personally interview any prospective Candidate before she/he interviews with the Family. 

3.6) The Service will only disclose if requested to the Family the relevant information for each prospective Candidate. (Name-Last Name)

4. Sitter Responsibilities

4.1) Uphold the highest level of safety and well-being of the children. Kids must have an acceptable grade of respect and behavior.

4.2) Provide a nurturing and engaging environment.

4.3) The Babysitter will only supervise 2 children at all times and the sitter will only supervise 2 kids at any time! If you have more than 2 kids an additional babysitter must be hired. For infants,  0 – 2 years old a single babysitter must be hired separately which is mandatory.

4.4) Plan and prepare meals and/or bottles to feed children only if instructed by the parents with a specific order in writing of what needs to be prepared.

4.5) Dress the children and/or change diapers.

4.6) Place the children down for naps and/or bedtime.

4.7) Our Babysitters will not perform housework during working hours. This includes but is not limited to play areas, toys, dishes, and all items used during care. The babysitter’s sole responsibility is to watch over the kids at all times to safeguard their well-being. Our babysitters will not perform housekeeping work. You may not request nor demand to wash dishes or do laundry work. The babysitter may do a voluntary chorus of her own free will which you can Tip her if she did do a good job for you. 

4.8) Extra duties such as Family dishes, laundry, household cleaning, etc. are not Sitter requirements, these are upon request and if you request this from the sitter you must tip them no less than USD 20.00. The sitter is not obligated even if tip is offered to do any household work as this is voluntarily. 

5. Terms of Payment

5.1) Client acknowledges and agrees that the Service facilitates the compensation between Client and Sitter, Client is responsible for paying Service directly and in advance to Pavia Party & Baby Equipment Rental Babysitting Services.

5.2) The client agrees to hold their credit/debit card information on file for the duration of the booking.  Any extra hour of service will be paid in cash to the sitter.

5.3) In the event the Client fails to pay Service all amounts, the Service refers such matters to a collection agency in your respective country. 

6. Confidentiality

6.1) All data provided to and/or gathered by the Service in the investigation of the Client is confidential and will be held in strict confidence by the Service and its employees.

6.2) The client agrees to keep all information provided by the Service confidential and will continue to keep that confidentiality at all times. 

7. Cancellation Policy

7.1) We strictly enforce a 24-hour prior cancellation and modification policy for all standard babysitting reservations. For last-minute and sudden changes in your pre-booked and paid reservation, we will charge a USD20,= fee to change your reservation. We charge 100% of the reservation change upfront and it’s not refundable should we be able not to change your reservation due to the non-availability of a babysitter for that period.

7.2) If the reservation is canceled or modified with less than the required 24-hour notice, the Client will be billed a flat rate of USD 60,= to compensate Sitter for lost hours. 

7.3) If the reservation is canceled with less than 24 hours notice, the Client will be billed for the entire booking.

7.4) Our babysitters must be treated with respect and kindness at all times. Should you or your kids disrespect or mistreat our babysitter you will be notified via email of the incident. If your kids do not want to obey or misbehave and do not follow orders from our babysitter you will be notified via e-mail or text message. If the behavior does not change our Babysitter has the right to stop giving the service for security reasons for her well-being and cancel the babysitting fully without any refund to you as the customer. 

7.5) Cancellations or modifications to your babysitting booking are not guaranteed outside the cancellation time frame and will not be honored for refunds if we can meet your request to change or cancel your booking. For Changes we charge USD 20.00 upfront none refundable without any guarantee whatsoever the change is successful.

Release of Liability

I agree, in taking advantage of “Pavia Party & Baby Equipment Rental Babysitting Services,” as a babysitting referral service of Oranjestad, Aruba, to release and hold harmless “Pavia Party & Baby Equipment Rental Babysitting Services,” from any claims, demands, suits, cost, and charges in connection with or arising out of the child care service, including but not limited to bodily harm, injury to a child(ren), property damage, except only for loss, harms, or injury occasioned by gross negligence or intentional misconduct by “Pavia Party & Baby Equipment Rental Babysitting Services”  In the case of a medical emergency, I understand that the service will act on my behalf if attempts have been made to contact me and I wasn’t available.
